PRIVACY POLICY

This privacy policy (“Policy”) describes how The Community Economic Development Fund Foundation, Inc. and its related companies (“Company”) collect, use and share personal information of consumer users of this website, WeTeachSuccess.org (the “Site”). “Related companies” means The Community Economic Development Fund Corporation, The Community Economic Development Fund I, LLC, and The Community Economic Development Fund Pool 2, LLC. This Policy also applies to any of our other websites that post this Policy. This Policy does not apply to websites that post different statements. It also does not apply to information you provide on a page operated by a third party, even if you reached that page from a link, embedded feature, or redirect on the Site, and it does not apply to information governed by a signed loan agreement or other written contract with us.

WHAT WE COLLECT

We get information about you in a range of ways.

Information You Give Us. We collect your‎ name, email address, password, demographic information (such as your gender and occupation), location (city) of residence and business (existing or contemplated); plans to create a business as well as other information you directly give us on our Site. This includes the information you provide when you register for an Account, enroll in or complete a course, submit an assignment, quiz, or interactive exercise, complete a contact or registration form, or use a chat feature on the Site. We also collect your course enrollment, progress, completion, and quiz results, and any content you post in a course or community area.

We also collect the email address you give us if you subscribe to a newsletter or updates through the subscription fields on the Site.

Information We Get From Others. We may get information about you from other sources. We may add this to information we get from this Site.

Information Automatically Collected. We automatically log information about you and your computer. For example, when visiting our Site, we log your computer operating system type, browser type, browser language, the website you visited before browsing to our Site, pages you viewed, how long you spent on a page, access times and information about your use of and actions on our Site. This information is collected by us and by the third-party services that operate on the Site, and those services may receive it directly.

The services currently in use on the Site include Vimeo for embedded video, SoundCloud for embedded audio, Jotform for the “Ask a Business Advisor” assistant, Contact Form 7 for the contact form, LearnDash, H5P and MemberPress for courses and course access, Moove Agency User Activity Tracking and Log, Pexeto Users Insights, tagDiv Newsletter for subscription sign-ups, tagDiv Social Counter, Google reCAPTCHA on the contact form, and Yoast SEO. MemberPress is used only to control access to course content, and no charge is made for that access. The Site is hosted by SiteGround, uses SiteGround security and performance tools and the Sucuri website firewall, and runs on the tagDiv theme. Each of these may set cookies or receive information about your visit. Google reCAPTCHA transmits information about your interaction with the page to Google in order to distinguish people from automated programs. Moove Agency User Activity Tracking and Log and Pexeto Users Insights work differently from the others: they run inside the Site’s own software rather than in your browser. Moove records the pages you open in order, the date and time, how long you stay, and actions such as selecting a button. Pexeto counts your visits and sessions and records which pages you opened. Neither one makes a video recording of your screen, and neither one captures what you type. Because they run on our own servers rather than in your browser, they begin keeping these records when you arrive rather than waiting for your choice on the consent banner. You may ask us at any time to show you or delete what they have recorded about you, using the contact information below. The full list of cookies and similar technologies on this Site, with the category each one belongs to, is published in the cookie declaration at https://weteachsuccess.org/cookie-declaration/, which is updated each time the Site is scanned.

Cookies. We may log information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.

We use cookies that are strictly necessary to operate the Site and, with your consent, cookies and similar technologies that measure how the Site is used and that support our educational programming and communications. The Site uses a consent management tool configured in prior-blocking mode: cookies and tags that are not strictly necessary do not fire until you consent to them through the banner. The banner controls cookies and tags that run in your browser. It does not control the activity records our own software keeps, which are described under What We Collect above. You may change or withdraw your consent at any time using the preferences link the banner provides. The banner governs only the pages of this Site and does not control cookies set on a third-party page you are sent to from the Site.

You can also remove or reject cookies through your browser settings, though parts of the Site, including course functionality, may not work as intended if you do.

The Site recognizes and honors the Global Privacy Control (GPC) signal. When that signal is enabled in your browser, our consent management tool treats it as a decline of the cookies and tags that are not strictly necessary, and we honor it whether or not a law where you live requires us to. Do Not Track is a separate and older browser setting with no common standard, and the Site does not change its behavior in response to it; the Global Privacy Control signal is the one we act on.

COURSES, EMBEDDED MEDIA, AND CHAT

Course content is delivered through a learning management platform and interactive content tools that record your enrollment, progress, responses, and completion. Video and audio lessons are delivered through embedded third-party players. Those players may load content from, and transmit information to, the provider that operates them, including your IP address and information about your viewing, whether or not you press play. The provider’s own privacy policy governs the information it receives.

If a chat feature is available on the Site, your conversation may be recorded, transcribed, stored, and reviewed by us and by the third-party provider that operates the feature, for service quality, training, recordkeeping, and security purposes. Notice of that recording appears in the chat window before the conversation begins. Please do not enter account numbers, Social Security numbers, or other sensitive personal information into a chat window. The chat feature is operated by an automated assistant rather than a person, and its responses are generated automatically. A notice to that effect appears in the chat window before the conversation begins. The provider that operates the chat feature states that it does not use conversations to train its own artificial-intelligence systems. That provider relies on outside artificial-intelligence services to deliver the feature, and it does not represent that those outside services refrain from using the information they receive to train their own models. Please do not enter anything in the chat that you would not want handled on those terms.

Your consent. By using the Site you expressly consent, in advance, to the recording, monitoring, and analysis of your communications, course activity, and interactions with the Site by us and by the service providers that operate its features on our behalf, as described in this Policy and in the Terms of Use. Those service providers act as our agents and at our direction. You may withdraw that consent at any time by discontinuing use of the Site and, where applicable, through the consent banner, and withdrawal operates prospectively only.

USE OF PERSONAL INFORMATION

We use your personal information as follows:

  • We use your personal information to operate, maintain, and improve our sites, products, and services.
  • We use your personal information to process and deliver contest entries and rewards.
  • We use your personal information to respond to comments and questions and provide customer service.
  • We use your personal information to communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners.
  • We use your personal information to link or combine user information with other personal information.
  • We use your personal information to provide and deliver products and services customers request.
  • We use your personal information to administer courses and Accounts, to track course progress and completion, to issue certificates or acknowledgments, and to keep the records our funders, auditors, and regulators require.
  • We use your personal information to secure the Site, to detect and prevent fraud and abuse, and to comply with law.

SHARING OF PERSONAL INFORMATION

We may share personal information as follows:

  • We may share personal information with your consent. For example, you may let us share personal information with others for their own marketing uses. Those uses will be subject to their privacy policies.
  • We may share personal information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
  • We may share personal information for legal, protection, and safety purposes.
  • We may share information to comply with laws.
  • We may share information to respond to lawful requests and legal processes.
  • We may share information to protect the rights and property of The Community Economic Development Fund Foundation, Inc., our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.
  • We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.
  • We may share information with those who need it to do work for us.
  • We share information with service providers that perform work for us, including website hosting, course platform and interactive content, video and audio delivery, online forms, email delivery, analytics, and chat services. Service providers are permitted to use the information only to provide services to us.
  • The contact form uses Google reCAPTCHA to tell people apart from automated programs. Google receives information about your device and your interaction with the page for that purpose, under its own privacy policy.
  • We may share information with our related companies identified above, and with our professional advisors, funders, regulators, and auditors where required.

We may also share aggregated and/or anonymized data with others for their own uses.

We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising. If we later place an advertising or measurement tag on this Site, we will describe it in this Policy and place it in the marketing category of our consent tool, so that it does not run unless you consent to it. The cookie declaration for this Site currently lists, in its marketing category, storage set by the embedded Vimeo video player and SoundCloud audio player and a Jotform cookie that records how you arrived at the Site. Those items are set by the services that provide those features, they are not advertising tags we have placed, and, like everything else in the marketing category, they are held until you consent to them through the banner.

INFORMATION CHOICES AND CHANGES

Our marketing emails tell you how to “opt-out.” If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your accounts and our business dealings with you.

You may send requests about personal information to our Contact Information below. You can request to change contact choices, opt-out of our sharing with others, and update your personal information.

You may also request access to the personal information we hold about you, correction of information that is inaccurate, and deletion of information we no longer need. We will respond within forty-five (45) days, and we will tell you if we need more time. We may need to verify your identity before we act on a request. We will not deny you access to a course, charge you a different price, or provide you a different level of service because you exercised any of these rights.

If we decline your request, we will tell you why. You may appeal that decision by writing to us at the address below with the words “Privacy Appeal” in the subject line or on the envelope. We will respond to an appeal within forty-five (45) days and will explain the reasons for our decision.

Some requests we cannot honor in full. We may need to keep information to maintain course and grant records, to comply with our legal, regulatory, funder, and audit obligations, to detect or prevent fraud, or to establish or defend legal claims.

You can typically remove and reject cookies from our Site with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Site works for you.

WHERE YOU LIVE: STATE, FEDERAL, AND INTERNATIONAL LAWS

This Site is operated from Connecticut and is directed to visitors in the United States. Privacy laws differ from place to place. This section explains which laws may apply to you and what we do about them. Where a law where you live gives you more protection than this notice does, that law controls for you.

United States federal law. The Federal Trade Commission Act prohibits deceptive privacy statements, and this notice is written to be accurate. The Children’s Online Privacy Protection Act governs information from children under 13, which we do not knowingly collect. The CAN-SPAM Act governs our marketing email, and every marketing email we send includes a way to unsubscribe. If you give us a mobile number and agree to receive text messages, the Telephone Consumer Protection Act governs those messages, and you may stop them at any time by replying STOP.

Connecticut. The Connecticut Data Privacy Act exempts nonprofit organizations such as the Foundation. We nevertheless give every visitor the rights to see, correct, and delete personal information described in this notice, and the right to appeal if we decline a request.

California. The California Consumer Privacy Act applies only to for-profit businesses that meet certain thresholds, and it does not apply to the Foundation. The California Online Privacy Protection Act requires this notice to be posted conspicuously and to describe the categories of information we collect, the categories of third parties we share it with, how you can review and change it, how we respond to Do Not Track signals, and its effective date, and this notice does each of those things. Under California’s “Shine the Light” law, we do not share personal information with third parties for their own direct marketing, so there is nothing to disclose in response to a request under that law. California residents may exercise every choice in this notice by contacting us.

Other states. Virginia, Colorado, Utah, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Jersey, New Hampshire, Nebraska, Minnesota, Maryland, Kentucky, and Rhode Island have consumer privacy laws of their own. Most of them exempt nonprofit organizations, and all of them apply only to organizations that handle the personal information of a large number of that state’s residents. Whether or not one of those laws applies to you, you may exercise the rights described in this notice, we will respond within forty-five (45) days, and we will tell you how to appeal if we decline. Nevada residents may direct us not to sell their personal information; we do not sell personal information.

Biometric and health information. We do not collect biometric identifiers such as facial scans or fingerprints, and we do not collect consumer health information, through this Site. Laws such as the Illinois Biometric Information Privacy Act, the Texas biometric identifier statute, and the Washington My Health My Data Act therefore do not apply to information collected here.

Visitors outside the United States. This Site is directed to people in the United States. We do not target people in the European Economic Area, the United Kingdom, Canada, Australia, or elsewhere outside the United States. If you visit from outside the United States, your information is transferred to and processed in the United States, where privacy laws may differ from those where you live, and by using the Site you consent to that transfer. If you believe a law where you live gives you rights over your information, contact us and we will respond in good faith; you may also complain to your local data protection authority.

Automated assistants and automated decisions. If a feature on this Site is operated by an automated or artificial-intelligence assistant, we tell you so before you begin using it. We do not use this Site to make automated decisions that have legal or similarly significant effects about you.

HOW LONG WE KEEP INFORMATION

We keep personal information only as long as we need it for the purposes described in this Policy, and then for as long as required by our legal, regulatory, funder, audit, and recordkeeping obligations or by an applicable limitations period. Course and Account records are kept for as long as your Account is active and afterward as those obligations require. When information is no longer needed for any of those purposes, we delete it or de-identify it.

SECURITY

As part of protecting the Site we log sign-in attempts and the internet protocol addresses they come from, and we log requests for pages that no longer exist, so that we can block automated attacks and repair broken links. This information is used for security and maintenance and is kept only as long as it is useful for those purposes.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Access is limited to those who need it to do their jobs. No method of transmission or storage is completely secure, so while we work to protect your information, we cannot guarantee its absolute security. You are responsible for keeping your Account password confidential.

CHILDREN’S PRIVACY

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us at the address below and we will delete it.

DISPUTES

Any dispute, claim, or controversy arising out of or relating to this Policy or to our information practices is subject to the notice, mediation, arbitration, class action waiver, fee, opt-out, governing law, and venue provisions in the Dispute Resolution section of our Website Terms of Use, which are incorporated into this Policy by reference. CHANGES TO THIS PRIVACY POLICY. We may change this privacy policy. If we make any changes, we will change the Last Updated date above. Changes apply prospectively from the date they are posted. If the change is material, we will also notify registered users by email at the address associated with the Account, or by a prominent notice on the Site, before the change takes effect. We keep a copy of each published version of this Policy and the dates it was in effect.
